GENERAL TERMS CONDITIONS OF RENT - RENTAL AGREEMENT

The following are general conditions of the rental agreement concluded between the company (hereinafter Scooter Taxi) and client. The identification details of both parties are listed on the Rental Agreement page and/or SMS, email or any other digital correspondence.

ARTICLE 1. USE AND STATE OF VEHICLE

1.1 YOU MUST PRODUCE WHEN HIRING A MOTORCYCLE

  1. Client valid driver licence.
  2. Client credit/debit card – Visa, MasterCard accepted.

OVERSEAS LICENCE HOLDERS MUST ALSO PRODUCE

  1. Client passport.
  2. Client international drivers permit (if above licence is not accepted in Queensland Australia).

1.2 The client receives the vehicle described on the contract agreement, in good working condition, registered and accessories (helmet, top box, key, tags, etc) and promises to keep and drive the vehicle in compliance with the Queensland traffic laws and in accordance with the specifications of the use of the type of vehicle rented. Helmets must be worn and secured appropriately, it is strongly advised to wear eye protection at all times whilst driving, eye protection and body protection is the responsibility of the client. Scooters are single seat registration, registered for one person only, it is illegal to ride with two or more people on single seat registration. The client is responsible for any fines or infringements for any law breach arising from more than one person on the scooter.

1.2 The scooter may only be driven by the client, no other persons. In the case when a customer does not comply with the conditions, all matters relating to the scooter is the responsibility of the client regardless of whom is the driver and the service can be cancelled with no refund of the amount paid.

1.3 The scooter rented can be used for professional purposes being only food and packages delivery and mail box delivery, it may not be used for races, jumping or any other form that is not delivery purpose.

1.4 It is explicitly prohibited to the client to change any functional technical characteristics of the vehicle, the keys of the vehicle, the equipment, the accessories and/or spare parts of the vehicle, as well as any modifications of the exterior and/or interior appearance of the vehicle (unless express written authorization from Scooter Taxi). Scooter Taxi will charge for any missing accessories.

1.5 It is illegal to drive on the Motorways (Highways exceeding 80Km limit) with a 50cc scooter. The client can ride on a Motorway/Highway with a 125cc engine or over. It is illegal to drive 50cc scooter in NSW unless you have a current RA or REA class motorbike License.

ARTICLE 2. BREAKDOWN AND ROADSIDE ASSISTANCE

If the scooter cannot be driven, or cannot be started, or there is a suspicion of a mechanical failure, odd sound or vibration, the scooter is not to be driven, the client must call the Scooter Taxi roadside assistance. This number is the main correspondence number of Scooter Taxi 0412 284 897.

2.1 Scooter Taxi shall charge the client for the misuses the roadside assistance service:

  • (I) lost keys or helmets,
  • (II) lack of gasoline or electric charging,
  • (III) engine cut-off safety button,
  • (IV) rescue of the vehicle from unpaved or unsuitable for driving roads, or ignorance of the properfunctioning of the scooter include misuse.

2.2 The distance covered by the Road Assistance is free for 15km radius from Surfers Paradise Qld and included in the price of the rental. For assistance outside this radius transport costs of $30 per 10km and will be responsibility by the client. Free assistance covers any mechanical failure to the scooter caused by wear and tear and problems arising from proper usage of the scooter being light bulbs, battery, brake pads and tyres. Any mechanical failures arising from improper use is the clients responsibility, including tyre punctures, broken mirrors, broken brake levers, panel damages, etc.

2.3 It is forbidden to transport the vehicle on board of any car, van, ship, train, truck or plane (unless expressly authorized written by Scooter Taxi).

2.4 Any damages caused by the client due to breach of any of the conditions stipulated in this article or caused by the use of the vehicle in contravention of any condition of this article and/or due to any usage other than the usage defined in the rental contract by the lessor, authorizes the lessor to withdraw the vehicle from the client and to charge the client the corresponding repair costs or other costs resulting from occurred damages by means of a SMS. email or written notice to the client.

2.5 The damage caused to the rented vehicle shall be charged in accordance with the general price list available from Scooter Taxi as requested.

2.6 If the scooter gets lost, stolen or robbed, the Client must present the keys of the scooter and a police report, otherwise the client must assume the whole cost of the vehicle.

ARTICLE 3. PRICE, DURATION AND EXTENSION OF RENTAL

3.1 The rental price corresponds to the price indicated in the rental contract agreement and has been established according to the initial rental price agreed with the client at the moment of signing the contract.

3.2 The client shall return the vehicle at the agreed return date, time and place specified in the contract. The return of the vehicle in a different place other from the place of pick up, without previous agreement, it implies an additional fee on the clients charge depending on location.

3.3 The service is considered finished once the vehicle and the keys have been handed over to Scooter Taxi, in office hours at the location it was rented, and under the conditions stipulated in the contract and this article.

ARTICLE 4. PAYMENTS

4.1 The client agrees to pay to Scooter Taxi:

  • a) The price specified in the contract, corresponding to the date and time period. Payments not paid on due date will be subject to immediate return of the scooter. Non payments will be referred to collection agencies which may include added fees and charges.
  • b) The corresponding amount of all fines, parking infringements, tolls or penalties for any kind of infringement to the scooter is the responsibility the client while driving the rented vehicle, as well as the charges for the delay of payment by the lessee and the judicial and court fees, administration out of court fees, which may occur to the lessee as a consequence of the above stated cases. In case of fines, Scooter Taxi will charge the client $50 for the administrative fees for handling unpaid fines.
  • c) An amount in the case that a Scooter Taxi employee’s presence is required at a tow pound in order to reclaim a vehicle that has been impounded. In addition the client shall also be responsible for payment of the fine derived from the scooter impound by local authorities that will be charged directly to the client or on the credit card of the client.
  • d) The amount of any damages caused by the client for whatever reason deriving from the circumstance of having caused disadvantages to third parties or to the lessor regardless of being insured. In the case of the lessor being insured, it is the lessor´s obligation to return to the lessee the amount that would have been charged in the absence of any insurance policy, after the lessor receives payment from the insurance company.

4.2 The payments of the costs specified in paragraph 4.1 are to be made by credit card, cash or bank transfer. If the case should arise that the lessee does not pay the aforementioned costs within 24 hours since occurred, the lessor has the right to deduct those costs from the credit or debit card and make a claim judicially or extra judicially without further formalities.

4.3 Scooter Taxi reserves the right to demand immediate return of any hired scooter without reason to the client. Any funds paid for advance hire will be refunded to the client.

ARTICLE 5. INSURANCE, THEFT, LOSS AND DAMAGE TO THE VEHICLE

5.1 The rental price includes Compulsory Third Party (CTP) insurance. If you are involved in a motor vehicle accident and you are at fault, Compulsory Third Party (CTP) Insurance will cover you for personal injury claims made by other drivers, passengers, pedestrians and cyclists who were involved in the accident. It will also cover you for your own personal injuries if you were not at fault, or only partially at fault for the accident. CTP does not cover costs for damage to any other vehicle or items in the result of an accident where the client is at fault.

5.2 Any damage to the vehicle or damage to any third party vehicle or other objects are not covered by any insurance, it is the clients responsibility for any costs arising from damages whereas the client is at fault in the case of an accident, including accessories (keys, helmets, etc.). Vehicle damages are not covered by the CTP insurance. Vehicles do not have third party or comprehensive insurance of any type and all damages are charged according to the General Price List.

PERSONAL TRAVEL INSURANCE:

Scooter Taxi recommends that the client has appropriate travel insurance, which offers cover while motorcycling. Scooter Taxi accepts no responsibility for a clients failure to arrange appropriate cover.

ARTICLE 6. MAINTENANCE AND REPAIR

6.1 The client is not authorized to order the repair of the vehicle, unless authorized by Scooter Taxi.

6.2 It is clients responsibility to stop the vehicle when a malfunction of the vehicle is detected and contact Scooter Taxi or the road assistance service.

6.3 It is the clients responsibility to check tyre pressure and wear. Client must check oil levels are appropriate at all times. All lights are in working condition.

6.4 It is the clients responsibility to notify Scooter Taxi of any tyre replacement required or oil changes that are black in colour, any lights not working.

6.5 The customer has no right of courtesy vehicle during the time of the mechanical check and repairs.

ARTICLE 7. FUEL AND OIL

7.1 The fuel and oil consumed during the rental period is paid by the client.

7.2 Client must refuel the vehicle with the correct type of fuel and oil, otherwise the client shall be responsible for the costs incurred for repair of damage produced in the vehicle by incorrect fuel, or not filling oil when indicator light displays, or incorrect oil.

7.3 The scooter has to be returned with the same gas level as previously marked in the contract. If the scooter is not returned with the same gas level, Scooter Taxi will charge $10.

ARTICLE 8. INCIDENTS

8.1 In the case of an accident with the rented vehicle, the client shall submit to Scooter Taxi:

  • Police Report
  • Details of all other vehicles involved including, Names, Address, Registration Number, License number, Phone Numbers, Pictures of all damages.
  • Full details of how the incident occurred.

8.2 Persons details and identification proof (Picture of license) must be completed by the parties involved no later than 48 hours from the time of the accident, except in cases of force majeure justified, and in any case always before the end of the rental. Incomplete or illegible Declaration of Accident are not accepted, and if so, will become clients responsibility to pay damages of the vehicle.

8.3 Non-delivery by the client to Scooter Taxi of the declaration of accident, will involve a minimum charge of $150, payable to Scooter Taxi and whatever the cost of the damage to the vehicle at the time of its return. This amount in any case may be altered by Scooter Taxi. The client has to clarify which party is responsible for the accident and, therefore, who is responsible for the damages to Scooter Taxi's vehicle.

8.4 If in case of an accident, the vehicle is not suitable for driving, Scooter Taxi it will retain it until completion of the formalities of damage expertise. In this case, the customer has no right to courtesy vehicle.

ARTICLE 9. MODIFICATIONS OF THE RENTAL AGREEMENT

The General Conditions and the remaining provisions of the rental agreement may only be modified by written agreement signed by both parties.

ARTICLE 10. ELECTRONIC PROCESSING OF PERSONAL DATA

The client authorizes the electronic processing of the personal data that appears in this contract, which are necessary for the contracted service as well as for the offer and conclusion of a contract for other products and services by the lessor. The client has the right to access, correct and cancel his personal data by a petition in writing to the lessor. The client also authorizes the lessor to cede his data to companies of the group, to his franchising companies or to others with whom the lessor collaborates for the best rental service of vehicles, resident either in Australia or abroad, respecting the Australian legislation of the protection of the personal data.

ARTICLE 11. APPLICABLE LEGISLATION AND JURISDICTION

11.1 The present contract will be valid and interpreted according to the Australian laws.

11.2 Issues concerning this contract between the Scooter Taxi and the client will fall within the competence/jurisdiction of the courts in Gold Coast, Queensland to which both parties shall submit.

ARTICLE 12. RESERVATION CANCELATION POLICY

If the cancellation is made with a notice of more than 24 hours, 100% of the paid amount is refunded. No refunds for cancellations with a notice of less than 24 hours.

If the cancellation of the booking is made without notice, the lessor will not proceed to any refund. Scooter Taxi is not responsible for the weather conditions.
